    Access to the facility with an equivalent effect solution in the built environment


    Scope of application

    Builders, owners and operators of establishments open to the public.

    Description

    Access to the public reception facility must be possible for all persons independently. In the built environment, architectural constraints may make independent access impossible.

    Solutions of equivalent effect (removable ramps) may be implemented as long as they meet the same objectives as the solutions prescribed by this order.

    When a solution of equivalent effect is implemented, the project owner must send the representative of the State in the department, prior to the work, the information required to verify that this solution meets the accessibility objectives.

    These elements are sent in triplicate unless they are sent electronically. The representative of the State notifies his reasoned decision, within three months of receiving the elements, after having consulted the competent commission in application of article R. * 111-19-30 of the construction and housing code. In the absence of a response from the commission within two months of the request for an opinion being sent, it is deemed to be favourable. In the absence of a response from the representative of the State in the department within three months of the date on which he/she received the request for agreement, the latter is deemed to have been granted.
