    Conditions for carrying on the tobacco resale business


    Scope of application

    The following businesses are authorised to sell tobacco as a complementary service:
    • on-trade pubs with a "licence III" or "licence IV";
    • restaurants holding a "restaurant licence";
    • service stations located on motorways or expressways (in Corsica, all service stations are authorised);
    • military establishments, prisons or establishments receiving people whose freedom of movement is restricted.

    Description

    The resale of tobacco products may be authorised as a complementary service for certain categories of retailer.

    Although the retail sale of manufactured tobacco is a monopoly of tobacconists, the resale of tobacco products is authorised as an additional service for the following businesses:
    • on-trade drinks outlets with a "licence III" or "licence IV";
    • restaurants holding a "restaurant licence";
    • service stations located on motorways or expressways (in Corsica all service stations are authorised);
    • military establishments, prisons or establishments receiving people whose freedom of movement is restricted.
    • The retailer must determine the tobacconist's outlet to which he will be attached, from which he must obtain his supplies exclusively, and whose manager is obliged to supply him with the quantities of tobacco he requests, up to a limit of 20 kg per month.
    Resellers are subject to the following obligations:
    • keep a resale book which must be presented for each supply (limited to 20 kg per month, except in exceptional circumstances) ;
    • set a selling price at least equal to the approved selling price;
    • offer manufactured tobaccos from at least 3 different manufacturers of his choice (any exclusive contract with a manufacturer or supplier is prohibited);
    • not to display tobacco products in the establishment for customers, users or staff to see;
    • not to sell tobacco in vending machines;
    • not alter the composition or presentation of the manufactured tobaccos it sells.
