Domain name declaration
Scope of application
Any website owner.
Description
By declaring your domain name to the Trade and Companies Register (RCS) you allow visitors to your website to ensure the legal existence of the company to which they are directed.
In addition, case law grants the holder of a domain name the right to bring an action in unfair competition against any reproduction or imitation of its sign (logo), subject to justifying prior use of said name domain. This prior use can be reported by any means.
The official mention of the domain name thus allows traders and e-commerce professionals to give it a certain date and to justify it, in the event of litigation, in an incontestable way with regard to the third party who would use it. It is therefore imperative to declare the domain names attached to the commercial operation of your company as soon as it is registered with the RCS.
