Maximum capacity of a bed and breakfast, cottage or furnished tourist accommodation
Description
The activity of renting out guest rooms is limited to a maximum number of 5 rooms for a maximum capacity of 15 people.
For gîtes or furnished tourist accommodation the capacity is also 15 people.

Beyond this capacity, the establishment will be considered as an ERP and will be subject to the various related accessibility and safety obligations.
The use of the name "chambre d'hôte" in order to mislead the consumer, when the maximum capacity is exceeded, will result in the hirer being sanctioned.
Note: the activity of renting rooms in private homes beyond the capacity of 15 people or 5 rooms is allowed, but in this case the lessor must no longer use the regulated name (e.g. "chambre d'hôte"). The lessor is nevertheless subject to all the obligations incumbent on operators of bed and breakfast establishments, particularly in terms of tax and social security, as well as to the regulatory provisions relating to accessibility and fire safety in the ERP applicable to all accommodation with sleeping quarters accommodating more than 15 people.
