    Mayor's prior authorization for permanent residence at home


    Scope of application

    This obligation applies to any natural person wishing to domicile the registered office of his company at his personal residence, if his address is located :
    • in a municipality with more than 200,000 inhabitants,
    • in the departments of Hauts-de-Seine, Seine-Saint-Denis and Val-de-Marne.

    Exclusion

    The obligation does not apply if 
    • the premise does not receive any client nor merchandise/goods ;
    • the premise is located on the ground floor, if the activity is carried out only by its occupants and does not cause any nuisance or danger to the neighborhood and does not lead to any disturbance to the building.

    Description

    Any legal person is authorised to set up his registered office in the domicile of his legal representative and to carry on an activity there, except as provided by law or contrary contractual stipulations (lease or by-law of co-ownership).

    The change of use of the premises intended for the dwelling is subject to a prior authorization of the mayor:
    • in municipalities with more than 200,000 inhabitants,
    • and in the departments of Hauts-de-Seine, Seine-Saint-Denis and Val-de-Marne.
    That being said, no authorization is required for the exercise of a professional activity, including commercial activity, in only a part of the residential premises of the legal representative of the company, provided that :
    • if the premises are not on the ground floor: that the activity is carried on only by its occupants and does not lead to receiving customers or goods, does not cause any nuisance or danger for the neighbourhood and does not lead to any disorder for the building;
    • if the premises are located on the ground floor: that the activity is carried out only by its occupants, does not cause any nuisance or danger for the neighbourhood and that it does not lead to any disorder for the building.
    In case of permanent domiciliation subject to prefectural authorization or approval, the proof of this must be attached to the application for registration (CCRCS Notice 04-22 and 03-56).
