    Public health and environmental alert register


    Scope of application

    Any private-law employer, unless it is a private employer. 

    Are also concerned :
    • public industrial and commercial establishments
    • public administrative establishments when they employ personnel under the conditions of private law;
    • the health, social and medico-social establishments mentioned in article 2 of law n ° 86-33 of January 9, 1986 laying down statutory provisions relating to the public hospital service as well as to the public health cooperation groups mentioned in 1 ° of article L. 6133-3 of the public health code.

    Description

    The purpose of this special register is to collect alerts :
    • the staff representative on the Social and Economic Committee (CSE), if one exists, who finds directly or indirectly that there is a serious risk to public health or the environment,
    • employees who believe that the company uses products that pose a serious risk to public health or the environment.
    The written warning must be dated and signed. It must specify the products or manufacturing processes used or implemented by the establishment which the employee or the staff representative on the ETUC considers to present a serious risk to public health or the environment, as well as their potential consequences.

    The employer examines the situation with the staff representative who sent him the alert and informs the employee of the action he intends to take on this alert.
