    Register of declarations of minor accidents at work (infirmary register)


    Scope of application

    Any employer having knowledge of a minor work accident (the accident does not lead to sick leave or medical treatment) meeting the following conditions :
    • permanent presence of a doctor, a pharmacist, a state-certified nurse or a person in charge of a health and safety mission in the company holding a national first-aid diploma supplemented by the work lifeguard diploma;
    • existence of an emergency first aid station;
    • establishment of a CSE if the company hires more than 11 employees.

    Description

    The employer or one of his employees must declare any accident of which he has knowledge.

    Instead of sending a declaration of accidents at work (compulsory until May 2021), the employer may make a simple entry in a specific register known as the 'infirmary register' or 'register of minor accidents' within 48 hours of the accident, if the following conditions are met

    • the accident does not lead to a stoppage of work or medical treatment;
    • the permanent presence of a doctor, a pharmacist, a state-qualified nurse or a person in charge of health and safety in the company who holds a national first aid diploma supplemented by a first aid diploma for the workplace;
    • the existence of an emergency first aid post;
    • the employer informs the ETUC of any entries;
    • the register is signed by the victim of the accident.
    The entry in the register must mention :

    • the name of the victim ;
    • the date, place and circumstances of the accident
    • the nature of the injuries, with the endorsement of the person who provided the care.
    The register must be made available to

    • the victim or his/her dependants
    • agents of the Carsat or the CPAM; - the labour inspectorate
    • the labour inspectorate;
    • the Social and Economic Committee (CSE);
    • the occupational physician.
    Note: the company must keep the register for each calendar year on the medium of its choice for a period of 5 (five) years from the end of the year in question.
