    Single Occupational Risk Assessment Document (DUERP) - Establishment, filing and updating


    Scope of application

    Any company with at least 1 employee.

    Description

    The professional risk assessment document (DUER), that the Health Law has recently changed, includes the following information:
    • Starting point of your company's prevention approach
    • Inventory of the risks identified in each work unit of your establishment, including exposure to hazardous chemical agents (HCAs)
    • Results of the assessment of risks to the health and safety of your company's employees, which must lead to :
      • for companies with less than 50 employees: on the definition of risk prevention and employee protection actions, which must be recorded in the single document and its updates.
      • for companies with more than 50 employees: on an annual program for the prevention of professional risks and the improvement of working conditions which :
        • establishes a detailed list of measures to be taken during the coming year, including measures to prevent the effects of exposure to occupational risk factors, as well as, for each measure, its conditions of implementation, result indicators and estimated cost;
        • identifies the company's resources that can be mobilized;
        • includes an implementation schedule.
    This document must be kept, as of March 31, 2022, for at least 40 years by the employer and made available to the following persons :
    • Employees (current and past)
    • Occupational doctor when integrated into your company
    • Members of the staff delegation of the Social and Economic Committee (CSE)
    • Inspector or labor controller
    • Occupational Health and Prevention Service as a whole
    The filing of the DUERP must be done in a dematerialized way:
    • as of September 30, 2022 for companies with less than 150 employees;
    • as of July 1, 2024 for companies with at least 150 employees.
    The single risk assessment document is updated:
    • At least every year, except for companies with less than 11 employees;
    • During any major planning decision modifying health and safety conditions or working conditions;
    • When additional information relevant to the assessment of a risk in a work unit is collected.
    In establishments with a social and economic committee, the single risk assessment document is used for the preparation of the annual report and prevention program for occupational risks.
