    Special provisions applicable to means of transportation of products of animal origin and foodstuffs containing them


    Scope of application

    This obligation applies to the retailing, storage and transport of products of animal origin using means of transport for products of animal origin and foodstuffs containing them, in particular to an approved cutting plant, a butcher's shop and an approved cold store.

    Description

    Provisions relating to transmissible sub-acute spongiform encephalopathies
    By way of derogation provided for in point 4.3(b) and point 10 of Annex V to the abovementioned Regulation (EC) No 999/2001, the transport of carcasses, half-carcasses, cut half-carcasses, quarters or cuts from bovine animals containing vertebral bone considered as specified risk material is authorised only to :
    • a) a cutting plant approved under Regulation (EC) No 853/2004 of 29 April 2004, the manager of which also complies with the provisions defined in A of Annex 3 of the aforementioned Order of 17 March 1992, for the purpose of holding and boning bovine carcasses and parts of carcasses containing vertebral bone considered to be specified risk material ;
    • b) a cold store approved under Regulation (EC) No 853/2004 of 29 April 2004, the manager of which complies with the provisions laid down in 1 and 2 of Annex II to this Order, for the purpose of holding bovine carcasses and parts of carcasses containing vertebral bone considered to be specified risk material;
    • c) a butchery workshop within the meaning of Section I of Annex V to this decree, authorised by the Prefect to hold and debone such carcasses or parts of carcasses. This authorisation is issued on the basis of an undertaking by the person in charge of the establishment to comply with the provisions defined in Annex V of this decree. The national list of authorised butchers' shops is published in the Official Bulletin of the Ministry of Agriculture. In addition, the manager of any establishment, excluding the cases provided for in a, b and c of this point, wishing to acquire, entrust, deliver, have delivered or transfer bovine carcasses or parts of carcasses containing vertebral bone considered to be specified risk material must comply with the provisions defined in B of Annex III of the aforementioned Order of 17 March 1992.
    Provisions specific to the transport of hazardous materials
    It is forbidden to load, before, during or after the transport of products of animal origin and foodstuffs containing them, freight likely to alter the health and quality characteristics of the products of animal origin and foodstuffs containing them through contamination, emanations, pollution or toxic inputs such as dangerous goods classified as toxic and/or corrosive within the meaning of the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR), with the exception of alcoholic beverages and cleaning, drugstore and hygiene products packaged in sales units intended for end users.

    Provisions specific to the support of armed forces
    For transport adapted to the support of armed forces in operation and training, special provisions are laid down by order of the Minister of Defence.
