Transfer of the registered office outside the domicile of the legal representative
Scope of application
Any legal representative of a company who has domiciled the company's head office at his or her personal residence.
Description
Any legal person is authorised to set up his registered office in the domicile of his legal representative and to carry on an activity there, except as provided by law or contrary contractual stipulations (lease or by-law of co-ownership).
The change of use of the premises intended for the dwelling is subject to a prior authorization of the mayor:

- in municipalities with more than 200,000 inhabitants,
- and in the departments of Hauts-de-Seine, Seine-Saint-Denis and Val-de-Marne.
- if the Mayor authorizes the reception of customers and/or goods, provided that this does not cause any nuisance or danger to the neighbourhood and that it does not lead to any disorder for the building,
- if the premises are located on the ground floor, the activity is carried out only by its occupants, does not cause any nuisance or danger to the neighbourhood and this does not lead to any disorder for the building.
In case of permanent domiciliation subject to prefectural authorization or approval, the proof of this must be attached to the application for registration (CCRCS Notice 04-22 and 03-56).
